We have some good news from US District Court Judge King. Our motion to remand to the arbitrator was granted for the purpose of completing the “make whole” remedy in the October 2019 Arbitration Award.

The Judge set 14 days to request Arbitrator Duffy retake the case to determine the remedy, 14 days from then to ask another arbitrator if Duffy won’t take the case, and 21 days for the parties to file a joint status report advising of whether the case should be stayed during the arbitration proceedings, and if not, proposing a schedule for further proceedings. The Judge also found, however, that the second wave of layoffs and equitable extension of the CBA are outside the scope of the remand for clarification and needed to be pursued through our separate grievance addressing the additional layoffs. Our legal team is currently considering what additional steps, if any, might be taken to address this issue. 

We know UNFI will keep fighting tooth and nail at every opportunity, and might even try to appeal. We understand that justice delayed is justice denied and will continue fighting to provide the remedy workers deserve and won.

Yesterday, our Union's legal team filed its brief opposing UNFI's petition to the U.S. Supreme Court challenging the ruling by the Fifth Circuit. The Government also filed a brief opposing UNFI and in support of the Fifth Circuit's ruling that President Biden had the authority to fire the Trump-appointed anti-union former NLRB General Counsel Peter Robb and rightfully exercised their prosecutorial discretion to withdraw the complaint against the unions after UNFI sought summary judgment. 

We are cautiously optimistic that the Court will throw out UNFI's latest desperate attempt to subvert your bargained-for rights and your rights under the arbitration award. We will continue to fight on your behalf until justice is served.

UNFI continues to take extreme steps to try and block your rights under the arbitration award.

Yesterday, UNFI filed a petition to the U.S. Supreme Court challenging an earlier decision by the Fifth Circuit denying their appeal. The Fifth Circuit had ruled in our favor that President Biden had the authority to fire the anti-Union former NLRB General Counsel Peter Robb.

Biden’s removal of Robb is an important turning point in our case because the Acting General Counsel that replaced Robb moved to dismiss UNFI’s ULP with the NLRB claiming that Arbitrator Duffy’s arbitration award violated the National Labor Relations Act.

This latest legal maneuver by UNFI is yet another desperate attempt to prolong this process and deny your rights. Rest assured, our Union’s legal team will not stop fighting on your behalf until every appeal by UNFI is exhausted and you and your families are vindicated.

We continue to watch for movement on our case but unfortunately there is nothing new to report. As previously reported, we are currently waiting for the US District Court Judge to rule on our motion to remand to the arbitrator. There is unfortunately no timeline for the Judge to decide. As you may have heard, Paul Dascher is currently serving as Secretary-Treasurer, with John Scearcy in an advisory role. Paul wants to assure you that our Union remains fully committed to defending your contractual rights and working to ensure that the arbitration award is upheld. As before, our legal team will continue to fight UNFI in the courts until justice is served. Whenever there is new information in the case, we will post it here.

In yet another victory for the Union and UNFI members, the Fifth Circuit denied UNFI’s request to rehear its ULP appeal en banc. This puts UNFI’s appeal to the NLRB’s decision to withdraw the Complaint against the Union to a close unless UNFI decides to petition the U.S. Supreme Court for cert.

Last week, we filed our response to UNFI’s Petition for a Rehearing En Banc in the Fifth Circuit case concerning UNFI’s NLRB appeal. We are now waiting for the Court to decide whether to rehear the case en banc, as UNFI has requested. Also, we are in full swing in the US District Court case concerning UNFI’s refusal to honor the arbitrator’s award. We have a reply in support of our motion to remand to the arbitrator to determine damages due to the Court this Friday.

In not so surprising news, UNFI is petitioning the Fifth Circuit for rehearing en banc (which means that all the judges in the Circuit would hear the case rather than just a panel).  This relates to the NLRB’s decision to withdraw the Complaint against the Union's and Biden’s authority to fire former NLRB General Counsel Robb.

On Monday, in an important win for the Union, the Fifth Circuit issued an opinion denying UNFI’s petition for review and upholding the NLRB’s own affirmation of then-Acting General Counsel Ohr’s decision to dismiss former GC Peter Robb’s ULP complaint against Locals 117 and 313.

We met on Friday, March 31 for our second
 (and last) day of mediation. As suspected, UNFI did not put a compelling offer on the table so we did not reach an agreement on damages. We are committed to moving forward and protecting the interests of our members. Next step to work through remedy issues is to submit a joint status report to the Judge on April 21.

Another win and a big step towards justice!!! This morning Judge King entered the attached order substantively granting the unions’ motion for summary judgment and denying UNFI’s cross-motion. Judge King upheld Arbitrator Duffy’s award, rejecting UNFI’s argument that the award exceeded the arbitrator’s authority or violated the NLRA. King’s reasoning is thorough and tracks the arguments we made to her on these issues, so we’re confident this decision provides a strong defense against UNFI’s potential appeal to the Ninth Circuit.

The decision orders the parties, as a next step, to submit a joint status report as to discovery on the damages phase of the case.

Th Union is actively working on next steps and will have additional updates on what is to come. Congratulations on a HUGE win!

Our Union’s legal battles with UNFI continue to move toward resolution.

The Fifth Circuit in the federal court system has scheduled oral arguments for June 6 on the NLRB’s withdrawal of its complaint against the Union.

There are two issues at stake that the Court will consider. The first is whether President Biden lawfully removed former NLRB General Counsel Peter Robb from office. Since the Fifth Circuit recently ruled in a separate case that Robb’s removal was indeed lawful, that issue appears to be settled in our favor.

The other issue is whether the NLRB’s interpretation of its procedural rules was correct involving a motion filed by UNFI. We believe that the NLRB acted correctly in denying UNFI’s appeal, and we are hopeful that the Court will lay that issue to rest.

Yesterday our Union’s legal team presented oral argument over the cross-motions for summary judgment in federal court before Judge King. Our team was well-prepared for the court appearance and made a strong, convincing case. UNFI’s lead attorney seemed to struggle to directly answer some of the Judge’s questions. The Judge indicated that she’d have a written decision “soon” – we’re hoping in the next couple of weeks. Although we can’t be certain of the outcome, we are cautiously optimistic that the Judge will rule to confirm our Arbitration Award. As soon as the Judge issues her opinion, we will let you know. Thank you for your incredible patience throughout this process. It has been a long haul to get to this point, but we believe we are an important step closer to a favorable resolution of the case.

Our call to the Judge’s chambers last week may have helped move this fight forward! Judge King has scheduled oral argument for April 26 on the cross-motions for summary judgment. This is great news and puts us one step closer to justice!

Our Union’s legal counsel reached out to Judge King’s chambers to inquire about the status of our case in federal District Court and to urge the judge to rule on the pending cross-motions in an attempt to impress on her the amount of time this case has been sitting on the docket and that the cross-motions have been pending.

The judge’s clerk said the case is on her radar but would not provide a timeline for issuing an order. Our hope is that our pressure will have an effect, but there is no guarantee. Although an order could issue any day, it’s possible we’ll be playing the waiting game for a while longer.

As we have said from the beginning, the legal process is very slow, and we anticipate a series of appeals…but we will see this fight through to the end and we will continue to update you with any new developments.

Last week, the NLRB filed its brief in the Fifth Circuit case defending Biden’s removal of former NLRB General Counsel Robb and its decision to withdraw the Complaint against the Union. We filed our brief on Tuesday.

As for the US District Court case on whether to confirm the Arbitrator’s award, we are waiting for the Judge's decision on our cross motions for summary judgment. There is no definitive timeline for the decision to issue. We will let you know of any future developments.

As we anticipated, the Department of Justice requested reconsideration of its motion to intervene in the Fifth Circuit case to defend Biden’s removal of NLRB’s former General Counsel Peter Robb which was denied on December 22. The Court did grant the NLRB’s request for a 30-day extension to file its brief in the case; the NLRB’s brief is now due February 14, 2022. Although this update doesn’t have much impact in our case, it is meant to keep you informed as promised.

On December 2, the Fifth Circuit denied the Department of Justice’s (DOJ) Motion to Intervene (defending President Biden’s removal of the former NLRB General Counsel Peter Robb) as untimely. The DOJ will likely request reconsideration of the ruling. We will keep you updated on the progress.

The Department of Justice may be moving to intervene in the case to defend President Biden’s removal of the anti-union, former General Counsel of the NLRB, Peter Robb. We will keep you updated on the impact this will have on our case.

The courts have set the deadline for UNFI to file its brief defending its position to overturn the Arbitrator’s Award for November 30. The NLRB’s brief will be due 30 days later, and our Union’s brief seeking to uphold the Award will be due seven days after that. With the holidays approaching, the courts may extend consideration of the case until the beginning of next year. Please stay tuned.

Your Union filed its motion for summary judgment in federal court, asking the court to enter an order confirming the arbitrator’s award.  UNFI filed its own motion for summary judgment, asking the court to set aside the arbitrator’s award. The briefings have been filed with the court, and the matter is now in Judge Jones’ hands for decision.

Another win for Teamsters!!! Once the Acting General Counsel for the NLRB sent out a status report denying UNFI’s flimsy appeal, Judge Jones, our assigned Judge in federal court, has lifted the stay on federal proceedings.

This is an important victory because it removes the pause on the court proceedings allowing us to resume our fight and move forward. Our legal team is busy preparing to refile a motion for summary judgement asking Judge Jones to find UNFI liable for breaching our CBA and enforce the arbitration award. UNFI’s greed is pushing them further into litigation, but all they reap is defeat. Stay strong, Teamsters!

The Acting General Counsel for the NLRB issued a decision denying UNFI’s appeal to the Board.

Although we expect UNFI to file a meritless appeal of that decision, your Union has moved forward to reactivate the federal case where we are seeking enforcement of Arbitrator Duffy’s decision and award.

Judge Jones, our assigned Judge in federal court, had stayed the federal proceedings pending resolution of UNFI’s charges against your Union.  With those charges completely dismissed, your Union’s legal counsel has filed supplemental authority seeking to remove the stay and have Judge Jones act in our enforcement action.

Despite the fact that UNFI has decidedly lost at the NLRB, we expect them to continue to deny their contractual obligations and continue to fight the Arbitrator’s decision. As we’ve demonstrated time and time again, your Union will never give up until justice has been served.

Great news! UNFI’s underhanded attempt to appeal the Acting General Counsel’s decision in our favor to the full NLRB has failed. In a stinging defeat to UNFI, the Board ruled today that it did not have jurisdiction over the case. UNFI is now waiting on a flimsy appeal to the Acting General Counsel’s office, which it filed on March 12. If this appeal fails as we expect it will, we believe the case will ultimately return and be resolved in the federal courts where we will get a determination on the merits of our claim to enforce the arbitration award. Our position in this fight continues to improve. Stay tuned!

As you know, the Acting General Counsel of the NLRB dismissed UNFI’s unfair labor practice claim against the Union. However, in true UNFI fashion, it has attempted to end run Acting General Counsel Orr by appealing directly to the full labor relations board and asking it to assume jurisdiction over the case. The Board has not yet issued any determination with respect to UNFI’s appeal.

In anticipation of the Board rejecting UNFI’s appeal, Local 117’s outside legal team is busy preparing for renewal of the Federal Court proceedings where we will finally get a determination on the merits of our claim to enforce the arbitration award.

We will update you as soon as the NLRB responds to UNFI’s ridiculous appeal.

UNFI CHARGE AGAINST 117 DISMISSED!

The Unfair Labor Practice charge that UNFI filed with the NLRB claiming that Arbitrator Duffy’s Arbitration Award violated the National Labor Relations Act was dismissed today by the Acting General Counsel!!!!!

As we have discussed, we are expecting that UNFI will continue to be extremely litigious and continue arguing that President Biden did not have authority to fire former NLRB General Counsel Robb.

In the meantime, we will refocus our energy on getting the stay lifted in the federal case. This is a huge victory…we’ve won rounds one and two and we are committed to fighting and winning the entire fight!

NLRB Acting GC Asked To Nix Challenge To Transfer Order

(February 1, 2021, 6:12 PM EST) -- Two Washington state Teamsters locals have asked the National Labor Relations Board's acting prosecutor to end a suit greenlighted by fired general counsel Peter Robb that could weaken union contract provisions making employers honor workers' negotiated job terms after transfers.

Teamsters Local 117 and Local 313 on Friday asked acting general counsel Peter Sung Ohr to withdraw a suit accusing them of seeking to make United Natural Foods Inc. discriminate against workers at its new Centralia, Washington, facility by letting workers at its shuttered Tacoma plant transfer in at higher wages per their union contracts.

NLRB prosecutors brought the case in July after UNFI challenged an arbitrator's award letting the Tacoma workers move to the Centralia plant.

"This case involves an attempt to aggressively move the law in a direction favored by general counsel Robb, to the benefit of corporate interests and the detriment of workers," the unions said in a letter to Ohr. The unions also asked the NLRB's Seattle office to push back a March hearing so Ohr can consider their request.

Ohr, a career NLRB staffer, was elevated to acting general counsel on Jan. 25 from his role as head of the agency's Chicago office. He is expected to walk back some legal positions taken by Robb, a former management-side labor attorney whom unions accused of favoring business in his role as the agency's chief prosecutor.

The UNFI case should be on Ohr's radar, the unions said Friday. The dispute dates to February 2019, when the food distributor announced plans to close its warehouses in Tacoma and Portland, Oregon, and operate a larger facility in Centralia, according to a portion of the arbitration award discussing the background of the case.

The unions demanded UNFI move Tacoma workers to the new plant under a contract provision giving workers a right to transfer at their current pay rates and benefits if the company moves its existing facility. The company refused, and the unions grieved the dispute through arbitration. In October 2019, arbitrator Joseph Duffy ruled for the unions, ordering UNFI to allow employees to transfer and reinstate workers already laid off.

UNFI challenged the ruling in two ways, suing to vacate the arbitrator's award in the Western District of Washington and filing charges with the board accusing the unions of meddling at a facility where it doesn't represent workers. The NLRB took up the case, accusing the unions of seeking to make Centralia discriminate by honoring more generous terms for Tacoma transferees, attempting to represent arbitrary bargaining units comprising Tacoma workers, and other alleged violations.

"The theories advanced by former general counsel Robb reflect a radical departure from existing NLRB and federal court authority," the unions said in their letter to Ohr, citing a series of rulings rejecting claims that unions violated the law by enforcing transfer rights in arbitration.

The complaint has also stalled help for about 280 workers who were laid off and not allowed to transfer because the district court has paused the unions' bid to enforce the arbitration award pending an end to the NLRB case, the unions said.

Teamsters Local 117 Secretary-Treasurer John Scearcy defended the arbitration award in a statement.

"The arbitrator's award is sound and upholds strong contract language that was negotiated and agreed to," he said. "This employer's attempts to undermine this award are rooted in greed and with complete disregard for workers' rights and the collective bargaining process."

A UNFI representative did not immediately respond to a request for comment Monday.

On Friday, January 29, 2021 we sent the following letter to NLRB Acting General Counsel Ohr to request review and reconsideration:

Dear Acting General Counsel Ohr,

Teamsters Locals 117 and 313 request reconsideration of the decision to issue a complaint in Case 19-CB-250856. As more fully explained in the Unions’ position statements in this matter (enclosed), this case stems from the Unions’ attempt to enforce language in their CBAs providing that if the company moved operations, employees would be allowed to transfer to a new location under the same terms and conditions of employment.

As more fully described in the Union’s position statements and briefing in the related federal court case(attached), the Board has had several occasions to address challenges to attempts to enforce contractual transfer rights like the ones at issue here, on the grounds UNFI advances here. The parties’ summary judgment briefing in Case No. 2:19-CV-01736-RAJ is particularly instructive in showcasing the ways in which the theories advanced by former General Counsel Robb reflect a radical departure from existing NLRB and federal court authority. That briefing walks through NLRB cases considering and rejecting the same legal challenges UNFI advances here (See Unions’ MSJ at pp. 13-14). UNFI’s summary judgment motion and opposition to the Unions’ motion are particularly noteworthy because they showcase the absence of on-point NLRB authority that supports the theories advanced in the Complaint. See Unions’ Response to UNFI’s Motion for Summary Judgment at pp. 12-19, discussing and distinguishing the cases relied upon by UNFI.

The pendency of this unfair labor practice charge against the Unions continues to cause real harm to workers who have been wronged by UNFI. Approximately 280 workers were laid off and denied the opportunity to transfer to the Centralia facility. Some of them have been out of work for almost two years, despite the fact that an arbitrator issued an award in October 2019 finding that UNFI is violating the CBA by denying them the right to transfer at their old rate of wages and benefit levels. A federal judge has rejected UNFI’s argument that the Unions are engaging in any type of representational conduct and has instead held that “the Unions have made no attempt to represent any employees at the Centralia facility,” and instead, “[t]he Unions have argued only that a term within CBAs—to which UNFI and the Tacoma facility employees are parties—provides an explicit extension of contractual rights to covered Tacoma facility employees who move to another location.” However, after Counsel for the General Counsel filed an amicus brief, Judge Jones stayed the federal case, preventing the Unions from being able to take any action to assist their members who are suffering because of UNFI’s blatant disregard of its contractual commitment to allow workers of a facility that closes to transfer.

This case involves an attempt to aggressively move the law in a direction favored by General Counsel Robb, to the benefit of corporate interests and the detriment of workers. Teamsters Local 117 and 313 respectfully request reconsideration of the decision to issue a complaint in this matter. We would welcome the opportunity to discuss the case further, or to address any questions the General Counsel’s office may have about the issues in this case.

Good news! President Biden has fired the anti-worker, anti-Union NLRB General Counsel Peter Robb, and we are waiting to see who will be appointed as acting General Counsel. (See our International Union's statement on the firing here.) This can only improve our chances at the upcoming hearing on the ULP charges scheduled for March 2021.

In case you still had any doubt, this proves that elections really do matter!

El 18 de septiembre, su unión y la UNFI presentaron sus respuestas a la Moción de Juicio Sumario de la otra parte en el caso de la corte federal.

Estamos esperando la decisión del Juez sobre las mociones de juicio sumario. Si el Juez falla a favor de unión, entonces habrá determinado que la UNFI es responsable de violar nuestro CBA. La siguiente fase de la demanda sería la determinación de la cantidad de daños que la UNFI debe pagar.  

Sin embargo, no hay duda de que si unión gana en responsabilidad, la UNFI presentará una apelación ante el Tribunal de Apelaciones del Circuito. Su objetivo será empatar el caso de la corte federal mientras que los asuntos de Prácticas Laborales Injustas (ULP) son determinados por la NLRB. 

Por el lado de la ULP, el Consejo General de la Junta Nacional de Relaciones Laborales presentó una enmienda a la reparación solicitada en la queja de Prácticas Laborales Injustas emitida por la Junta contra el unión. El Consejero General ahora pide una orden para exigir a unión que retire su oposición a los esfuerzos de la UNFI para anular el laudo del árbitro Duffy en un tribunal federal. 

Nuestras posibilidades de prevalecer en última instancia en su nombre depende directamente de si hay un cambio en la actual administración presidencial. Si los miembros de la NLRB, incluyendo el Consejero General, no cambian - y no lo harán si no elegimos un nuevo Presidente - entonces es seguro que la NLRB hará todo lo que esté a su alcance para asegurarse de que la UNFI gane.

El lunes, según lo ordenado por el Juez Jones, tanto la UNFI como su unión presentaron mociones para un juicio sumario en el caso de la corte federal.

Además, la Junta Nacional de Relaciones Laborales presentó un escrito amicus (amigo del tribunal), instando al Juez a reconsiderar su decisión de denegar la moción de la UNFI de suspender los procedimientos del tribunal federal en espera del resultado de los procedimientos de la NLRB. No está claro si el Tribunal siquiera considerará este escrito porque las normas del tribunal no permiten específicamente tales escritos amicus durante esta etapa del procedimiento. El intento de la NLRB de intervenir en los procedimientos del tribunal federal demuestra lo aliada que es la junta con la UNFI. Una vez que sepamos si el Juez Jones considerará el amicus curiae de la NRLB, los pondremos al día.

El siguiente paso en el procedimiento de la Moción de Juicio Sumario ante el Juez Jones es que cada parte presente su oposición a la Moción de Juicio Sumario de la otra. Se las proporcionaremos cuando se presenten dentro de unas semanas.

¡Emocionantes novedades! El juez del caso de la corte federal denegado La moción de la UNFI de suspender el procedimiento hasta que la NLRB decida los cargos que la UNFI presentó contra el unión. El Juez dijo que este asunto es contractual y NO representativo, por lo que tiene la jurisdicción primaria para decidir si mantener o anular el laudo arbitral. 

El Juez Jones también emitió una orden de programación que requiere que el unión y la Compañía presenten contra-movimientos para un juicio sumario antes del 20 de agosto. Las mociones serán anotadas para la audiencia del 18 de septiembre.

ORDEN DE PROGRAMA firmada por el Juez Richard A. Jones. Habiendo negado la Moción de Suspensión Temporal del Demandante [24], pendiente de la resolución del cargo de la NLRB, y habiendo considerado el Informe de Estado Conjunto de las partes [28], la Corte adopta el acuerdo de las partes de bifurcar este asunto con la Corte para hacer una determinación sobre la responsabilidad y luego considerar la cuestión de los daños sólo si la responsabilidad se determina a favor de las Uniones. La fecha límite para unirse a las partes adicionales es el 23/10/2020. En cuanto a la cuestión de la responsabilidad, las partes presentarán contraindicaciones para un juicio sumario a más tardar el 24 de agosto de 2020, los escritos de oposición se presentarán a más tardar el 14 de septiembre de 2020, los escritos de respuesta se presentarán a más tardar el 18 de septiembre de 2020 y las contraindicaciones se anotarán para el 18 de septiembre de 2020. Si el Tribunal resuelve a favor de las Uniones sobre la cuestión de la responsabilidad, el Tribunal fijará un plazo de 120 días para que las partes completen las pruebas relativas a los daños y perjuicios, así como otros plazos previos al juicio. Como se anticipó y se discutió en nuestra reunión del Zoom del 20 de junio, hemos recibido la notificación de la NLRB de que emitirá una queja contra unión basada en los cargos de la UNFI. La queja se emitirá después de que la Junta haga intentos de acuerdo. Una vez emitida, presentaremos nuestra respuesta a la queja y se programará una audiencia. Los mantendremos informados tan pronto como tengamos más información.

El jueves 21 de mayo, nuestro equipo legal de unión, junto con un asesor legal externo, tuvo una conferencia telefónica con el Consejero General de la Junta Nacional de Relaciones Laborales y el abogado de la División de Asesoramiento de la NLRB. En esa llamada, nuestro equipo legal respondió a una serie de preguntas relacionadas con el laudo arbitral. Puede leer las preguntas y nuestras respuestas a las cuestiones planteadas en la llamada en un documento preparado por nuestro equipo legal aquí.

Organizaremos una reunión en Zoom, una plataforma de videoconferencia en línea, para los miembros de unión que han sido afectados por el caso. En esa reunión, tendrán la oportunidad de discutir temas relacionados con el caso con nuestro equipo legal de unión. Tan pronto como se programe esa reunión, se lo haremos saber.

El jueves 14 de mayo, nuestro unión presentó una moción de sentencia sobre los alegatos y nuestra propuesta de orden, pidiendo al juez federal que confirme nuestro laudo arbitral. El próximo jueves 21 de mayo, nuestro equipo legal de unión, apoyado por un asesor legal externo, tiene una conferencia telefónica con el Consejero General de la Junta Nacional de Relaciones Laborales y el abogado de la División de Asesoramiento de la NLRB. En esa llamada, discutiremos los cargos de Prácticas Laborales Injustas de la UNFI, alegando que el premio violó la Ley Nacional de Relaciones Laborales. Los pondremos al día después de nuestra conversación con la NLRB la próxima semana.

Antecedentes: La UNFI presentó dos acciones para evitar el cumplimiento del laudo arbitral del árbitro Duffy, que determinó que los empleados de Tacoma tenían derechos de transferencia y el derecho a seguir trabajando por los mismos salarios y beneficios en la instalación de Centralia. Presentó cargos de Práctica Laboral Desleal ante la NLRB alegando que el laudo arbitral violaba la Ley Nacional de Relaciones Laborales. También presentó una demanda federal (Número de caso: 2:19-cv-01736-RAJ) buscando anular el laudo arbitral. 

La Región 19 de la Junta Nacional de Relaciones Laborales ha enviado los cargos por prácticas laborales injustas de la UNFI a la División de Asesoramiento para decidir si seguir adelante con el caso. 

Mientras tanto, la UNFI le pidió al juez federal en el caso federal que "se quede" (por ejemplo, pausa) la acción federal mientras se desarrollaba el caso de la NLRB. Nos opusimos a esa moción y estamos esperando que el juez dictamine.

Actualización: Su unión continúa llegando a los abogados de la División de Asesoramiento para que intervengan a ese nivel, pero hasta ahora no han podido contactar con nadie y no está claro si la oficina de la División de Asesoramiento está abierta durante la crisis de COVID-19.

En el caso de la corte federal, estamos preparando una moción de juicio sumario, pidiendo al juez federal que "confirme" el laudo arbitral. Planeamos tener nuestra moción completamente preparada y presentada para el 14 de mayo de 2020. Actualizaremos este hilo una vez que esa moción sea presentada.

En un esfuerzo por mantenerlos a todos actualizados en el procesamiento del litigio, contactamos a la corte para una actualización de la situación hoy. La única información nueva es que la moción de suspensión que se presentó el 24/01/2020 está en la cola de la Juez Jones. La corte no pudo proveer un marco de tiempo para una decisión. Como hemos compartido antes, este es un proceso legal lento que presumiblemente se retrasa aún más por el personal y la carga de casos prioritarios en relación con la crisis de COVID-19. Aunque esta actualización no incluye ningún acontecimiento importante, los miembros nos han pedido y nos hemos comprometido a proporcionar actualizaciones periódicas, no importa cuán grandes o pequeñas sean.

Como saben, la UNFI presentó acciones tanto en la Corte Federal como en la Junta Nacional de Relaciones Laborales (NLRB) contra la unión para impugnar el laudo del árbitro Duffy. En la acción del Tribunal Federal, la UNFI presentó una moción para suspender (poner en espera) esos procedimientos hasta que la NLRB se pronunciara sobre sus cargos. Sospechamos que los motivos de la Compañía para presentar la moción de suspensión son seguir bloqueando sus derechos en virtud del laudo y ralentizar el proceso en la medida de lo posible. El juez aún no ha dictaminado sobre esa moción. Tan pronto como tengamos noticias del juez, se lo haremos saber.

En el NLRB regional oficina (región 19)nuestro equipo legal externo de uniónpresentó una declaración suplement aria hace unas semanas. Nuestra declaración proporciona una buena visión general de nuestros principales argumentos en el caso y solicita que la Junta desestime los cargos de la UNFI. Para informarse, por favor tómese un tiempo para revisar este documento. Desde entonces,la oficina regional no ha podido tomar una determinación sobre los cargos de la UNFI (probablemente por razones políticas) y ha presentado los cargos al Asesor Jurídico General de la Junta de Revisión de la Legislación Nacional (nombrado por Trump) para que le dé "asesoramiento". Sospechamos que el "consejo" del Asesor General será llevar estos cargos a la audiencia. Nos estamos preparando para este resultado. Manténgase en sintonía para más información.

La UNFI ha presentado una moción para suspender el procedimiento en la corte federal. Piden al juez que suspenda (lo que significa detener el proceso) el procedimiento en la corte federal hasta que los procedimientos de la NLRB concluyan. Estamos presentando nuestra objeción a esa moción hoy, y la audiencia de la moción es el viernes.

Como muchos de ustedes saben, nuestra unión presentó y ganó un laudo arbitral relacionado con la transferencia de trabajo a Centralia. Desafortunadamente, la UNFI se ha negado a honrar la decisión de arbitraje y en su lugar ha presentado apelaciones ante la Junta Nacional de Relaciones Laborales (NLRB) y en la Corte Federal. Las siguientes actualizaciones están relacionadas con el litigio sobre la apelación de la UNFI:

Cargos por prácticas laborales injustas de la UNFI contra el unión con la NLRB:
El unión ha presentado su declaración de posición y sus pruebas a la NLRB. La NLRB considerará ahora nuestra declaración de posición antes de decidir si investigar la reclamación de la UNFI.

Apelación de la UNFI de ladecisión de arbitraje del árbitro Duffy al Tribunal Federal:
Nuestra unión ha presentado su respuesta a la reclamación de la UNFI y ha hecho valer las contrademandas contra la UNFI para la ejecución del laudo. Nuestras contrademandas contra la UNFI son: 1) confirmación del laudo; 2) medidas cautelares para hacer cumplir el laudo; y 3) incumplimiento de contrato. El Tribunal amplió el plazo de la UNFI para responder a nuestras contrademandas hasta el 17 de enero de 2020.

Aunque los litigios son lentos, nos comprometemos a mantenerlos informados con mensajes y alertas de texto a medida que avanzamos en este proceso. Como muchos de ustedes saben, nuestra unión presentó numerosos cargos por Prácticas Laborales Injustas (ULP) ante la Junta Nacional de Relaciones Laborales durante el último año, alegando que la UNFI se involucró en interferencia, comunicaciones despectivas, vigilancia, cambios unilaterales y más. Aunque estos cargos no están relacionados con el arbitraje y el litigio en curso sobre el laudo (apelación), creemos que es importante mantenerlos informados sobre el progreso:

La audiencia de estos cargos fue programada para el martes 7 de enero de 2020. El 2 de enero de 2020, la Junta Laboral llegó a un acuerdo con la UNFI, requiriendo a la empresa a enviar un aviso a los actuales y antiguos miembros del Local 117 y 313 estableciendo las obligaciones legales de la UNFI a sus empleados bajo la Ley Nacional de Relaciones Laborales.

Como se mencionó anteriormente, la UNFI tiene el mandato de enviarle por correo una carta en la que se establecen las obligaciones legales de la UNFI con sus empleados en virtud de la Ley Nacional de Relaciones Laborales. Esperamos que esa carta sea enviada dentro de la próxima semana o dos. Esta carta no requerirá ninguna otra acción por su parte. Aunque esto pueda parecer insignificante, marca otra victoria de Teamster contra este empleador que no podría ser posible sin la participación y el testimonio de muchos de ustedes.

Hemos pedido a nuestro equipo legal que redacte una actualización relacionada con el litigio sobre el laudo arbitral y el proceso de apelación. Tenemos la intención de proporcionar esa actualización pronto.

Teamsters 117 establece el Fondo de Dificultades de la UNFI, destinado a ayudar a los miembros de la instalación de la UNFI en Tacoma que estén experimentando dificultades financieras extremas como resultado de haber sido despedidos ilegalmente por la UNFI.
