As a result of a Labor & Industries ruling, we've signed a Memorandum of Understanding with the DOC clarifying our collective bargaining agreement to ensure that it is in compliance with State law.

The change impacts the overtime provision of our contract (Article 17, Section 17.2).

Per the ruling from L&I, the State's new Paid Sick Leave and Paid Family Leave laws allow you to use leave when you decline mandatory overtime in the event that you are sick or you need to care for a sick family member. An employee who utilizes leave under this provision will not be the first to be called when mandatory overtime is required.

If you wish to use leave in this way, you must complete a leave form immediately after reporting that you are unable to work overtime. You will be paid for the requested leave at the straight time rate.
